[Unpad.ac.id, 27/04/2016] Legality of Letter of Decree (SK) and letter of assignment in Universitas Padjadjaran did not only relate to being documents of administrative, administration or official matter. More than that, SK is a legal product with legal consequence and validity.
“SK and letter of assignments are not only a simple administrative matter. They are legal basis for all activitites conducted by leadership, lecturers and administrative staffs,” said the Lecturer of Facutly of Law Unpad Abi Ma’ruf Radjab, SH., MH., during a session in Technical Training of Legal Drafting at Unpad Training Center, Jalan Ir. H. Djuanda No. 4, Bandung, Wednesday (27/04). Participating in this training is Head of Division and Subdivision in Unpad. This event were officially opened by Director of Governance and Public Communication, Dr. Soni A. Nulhaqim, S.Sos., M.Si.
Since they are legal documents, SK and letter of assignments needs to be drafted in accordance to their authority. Abi said that many times SK and letter of assignment drafting were erroneous. One of errors was drafting a copy pasted parts from previous documents.
As example, Abi said there was SK for administrative staff but with law reference were for those of Lecturers. He also said that he found SK of procurement with law reference to law of Lecturers. With the Higher Education Law, said Abi, it could serve as the main reference for SK drafting in Unpad.
“We were under the impression that all the law reference needs to be included in SK, that the number of law becomes important. Yet the error made the document incoherent,” said Abi.
This legal reference needs to be a point of consideration for SK drafter. Abi said that there were many SK documents that still referred to old law references
“Updated law reference is most needed in SK and letter of assignments drafting. We must avoid copy-pasting,” he said.
Moveover, Abi said, the next error in SK drafting in Unpad was the sense of ‘regulate’. The regulation authority only occurred in Regulation Documents from Rector. SK authority was merely to set, appoint, discharge, transfer, rotate, or apply a particular task.
Meanwhile, Dr. Soni said that Unpad will draft standards for SK or letter of assignment draft. By this standard, SK and Letter of assignment would be in accordance with Unpad values, as Head of Division and Subdivision agreed upon during the technical guidance.*
